These Terms of Service govern your use of BabyApp, a baby-care tracking application published under the APHEXON brand. By creating an account or using BabyApp, you agree to these Terms. If you do not agree, do not use the service.
1. Who BabyApp is for
BabyApp is designed for parents and caregivers who are legally permitted to enter into these Terms. It is not designed for independent use by babies or young children. You are responsible for having the authority to record information about a child and to invite anyone who receives access to that information.
2. What the service does
BabyApp lets you record and review baby-care information, such as feeding, sleep, diaper changes, growth and milestones, to the extent those features are available in your app version. Features, availability and limits may differ by version, platform and subscription status. We may update, discontinue or replace features, subject to applicable law and any rights arising from your purchase.
3. Not medical advice
BabyApp is a personal record-keeping and parenting-support tool, not a medical device or emergency service. It is not intended to diagnose, treat or prevent medical conditions and is not a substitute for a qualified healthcare professional. Consult an appropriate clinician about your child's health or development. For an emergency, contact local emergency services rather than relying on BabyApp, its reminders or its records.
4. Accounts and security
You may be asked to sign in with an email address using a one-time password. Provide accurate account information, protect your sign-in method and notify us if you suspect unauthorised access. You are responsible for activity conducted through your account except to the extent the law provides otherwise.
5. Your records and permitted use
You retain any rights you have in text, photos and other content you submit. You give us and our service providers the limited permission needed to host, process, synchronise, display and delete that content to provide BabyApp and carry out your instructions, subject to our Privacy Policy.
You must not use the service unlawfully, impersonate others, upload content you are not authorised to use, abuse other people's privacy or interfere with BabyApp's security and availability.
6. Shared caregiving
If BabyApp supports caregiver sharing, you control whom you invite and which permissions you grant through available controls. Shared caregivers may see or change data within permissions granted to them. Removing access does not guarantee another person has deleted information they already lawfully downloaded or copied. Deletion of shared data depends on the account and record ownership rules implemented in the app.
7. Advertising
The ad-supported version of BabyApp may show third-party advertising, including ads delivered through Google AdMob. We do not endorse every advertised product or service. Advertising practices and applicable choices are explained in our Privacy Policy. Any ad-free entitlement applies only as described in the relevant offer.
8. Paid features and subscriptions
Where BabyApp Pro or other paid features are offered, their price, currency, billing frequency, trial terms (if any) and included benefits will be shown before purchase. Purchases through Google Play are processed under applicable Google Play purchase and subscription terms. An auto-renewing subscription may renew at the displayed rate unless cancelled before the next renewal as described in the purchase flow, subject to applicable law and Google Play notifications.
Manage or cancel a Google Play subscription in Google Play โ Payments & subscriptions โ Subscriptions or at Google Play subscriptions. Uninstalling BabyApp, deleting data or requesting deletion of your BabyApp account does not, by itself, reliably cancel a Google Play subscription. Cancel through Google Play to prevent future renewals. Access after cancellation and refund eligibility are governed by the purchase terms and applicable law.
9. Availability, backups and exports
We aim to keep BabyApp available, but internet access, devices, third-party services and software may fail or change. Where exports are available, keep a copy of records you may need independently. Do not depend on BabyApp as the sole place for time-critical medical or childcare instructions.
10. Privacy and deletion
Our Privacy Policy explains how information is handled. You can request account deletion through the available in-app account settings or our public Delete your BabyApp account page. Deleting an account may permanently remove access to its data and app-specific entitlements, subject to applicable legal rights and any separately managed store subscription.
11. Changes and termination
You may stop using BabyApp or request account deletion at any time. We may limit access where reasonably necessary to protect users, comply with law or address serious misuse, taking account of applicable legal requirements. We may revise these Terms and will publish the new date and provide further notice where appropriate. Continued use following an effective update indicates acceptance where permitted by applicable law.
12. Liability and applicable rights
BabyApp is provided subject to the consumer rights and remedies that apply in your location. To the extent permitted by law, APHEXON does not guarantee uninterrupted service or that user-entered records are complete or medically accurate. Nothing in these Terms excludes rights or liability that cannot lawfully be excluded.
